Dear Mr Atkinson,

Thank you for your telephone call this morning and CHCH TV’s interest in our Application for a Writ of Habeas Corpus and Notice of Motion set for Friday, November 17, 2008 before three Justices of the Court of Appeal for Ontario at Osgoode Hall Toronto at 10 am.

In short, our Motion Concerning the Churches Building at 544 Barton St., E., Hamilton, which the Hamilton Police Service and Crown seized via the forfeiture order of Justice Cavarzan last April, will be heard this Friday, November 17, 2008. Our Motion (copy below) is for an order issue that Her Majesty the Queen reimburse Ray Edwards Realty the $22,104.37, demanded in their Notice of Sale Under Mortgage.

It is the onerous conditions of our Recognizance of Bails which caused us to default on the Churches mortgage and we are asking the court to also vary our recognizance of bails to permit us to live at 544 Barton St., E., and to attend there and associate with each other pending the out come of our appeal which is to be spoken to on Monday, November 17, 2008.

NOTICE OF MOTION (In support of Habeas Corpus Application, November 14, 2008) TAKE NOTICE: that the Applicants in this Inmate Appeal, Reverend Brother Michael J. Baldasaro and REVEREND BROTHER WALTER A. TUCKER, will make a Motion to three Justices of this Honourable Court, on Friday, November 14th 2008, at 10 o’clock in the forenoon or as soon thereafter as the Motion can be heard, within the hearing of the Applicants Habeas Corpus Application, set for November 14th, 2008, at Osgoode Hall, 130 Queen Street, West, Toronto, Ontario, Canada. The Hearing of the Motion will take approximately ½ hour.

The List Judge, Justice Simmons advised the Applicants via telephone conference November 7th 2008, that the Court could entertain more than the ½ hour set for the hearing of the Habeas Corpus Application.

THE MOTION IS FOR:
1. An order issue commanding the Respondent reimburse Ray Edwards $$22,104.37 as demanded in the Notice of Sale Under Mortgage, dated October 17th, 2008 and such further and other costs and disbursements as proper, together with interest, at the rate of 14%;
2. A copy of the video record of this Hearing as recorded by the Court of Appeal, inclusive of all recordings of all Hearings concerning the Applicants herein;
3. Directions and such further and other relief as may be advised and admitted. The grounds for the application are as follows:
4. the making of the Recognizance of Applicants, by the Crown has brought the Applicants, as Trustees of The Assembly of the Church of the Universe, bankrupt and has brought the administration of justice into disrepute. a) Notice of Application for Habeas Corpus to be heard November 14th 2008 and supporting materials; b) Courts of Justice Act, Section 95.(1), 96.(1)(3), 97., 98., 100.; c) Canadian Charter of Rights and Freedoms, Section 24.(1), 52.(1) et al.;
5. Such further and other grounds as advised and admitted. The following materials will be used in support of the hearing of the Motion;
